1. Terms of Use

Welcome! The following are the Policies and Terms of Use (“Terms” or “Agreement”) that govern your use of Girlcation sites and mobile applications, including without limitation www.girlcation.com and www.girlcationjamaica.com— (collectively, the “Site”), and your purchase, possession, or use of any Girlcation events, tickets, products or services; Event’s companies, organizers, services, products and events referred to herein as either the “Company”, “Event”, “Girlcation”, “We” or “Us”.
By visiting or using this site, you expressly agree to abide, be bound by and follow these Terms, as updated from time to time, as well as all applicable laws, ordinances and regulations. You represent that you are legally able to enter into this binding contract and that you are over the age of 18. You agree that by accepting the terms of these Terms and Conditions (by clicking upon the "Accept", "Agree", "Yes", or similarly identified button, as the case may be), your act of accepting thereby shall confirm that you have read and understood these Terms and Conditions and that you agree to all of its terms, to the same extent as if you read a paper copy of these Terms and Conditions and placed your signature on such paper copy with your own hand.
If you do not agree with ANY OF the the terms and conditions set forth in this Agreement, do not purchase Tickets.

 

2. Overview of Terms and Conditions

This serves as an overview of the terms and conditions contained in this agreement; this paragraph does not cover all terms listed or details of terms listed, but rather a highly abridged version of some of the points listed below.
  • No refunds. All sales are final. (See Cancellation Policy)
  • You must have a valid passport (and potentially other documents) to enter into the country of Jamaica.
  • Event is subject to change (itineraries, lineup/artists/performers, dates, times, location, prices etc.), and Event retains the right to modify, reschedule or even cancel your reservation and/or event at any time for any reason, including force majeure, Covid-19 or other pandemic/epidemic related protocols or laws, or any other reason; in the case of event cancellation, you may offered a partial refund, full refund, no refund, or rescheduled event, at the sole discretion of the Event.
  • You must follow all laws and regulations, including Covid-19 and other health guidelines in place at the time of the event.
  • Fees may vary and are non-refundable. Payment plan fees are $100 per person, per ticket. Late payments incur a $45 fee each late payment and your account may be subject to cancellation if in default. You are responsible for paying applicable taxes.
  • Ticket and matching Valid ID must be used for entry. You must be (18) years or older to attend. All attendees are subject to a security check at the event and are not allowed to bring any prohibited items.
  • No ticket resales or transfers.
  • Zero tolerance drug or violence policy at the event.
  • You must follow our “Code of Conduct” at the event.
  • Event is not responsible in any way for 3rd party vendors such as; shuttles, ground transportation, airfare, hotels, excursions or vendors.
  • Photography is permitted for personal use only, and is not allowed during most performances, unless stated otherwise. Videos and flash photography are strictly prohibited inside the venue. Attendees may not bring professional photography/audio recording or video equipment.
  • Anyone entering the event consents to being recorded, filmed and photographed and has granted permissions to the Event to depict or otherwise use their image, likeness, voice, and actions as embodied in such photographs(s), recordings, film and/or video in perpetuity.   • You acknowledge there are risks and dangers of attending an event and indemnify the Event and all related companies from any such accidents, injuries, death, loss, cost, claim, delay, or damages of any kind related to your purchase of or attendance to the event.

3.1 Cancellation Policy / Refund Policy

All sales are final, non-returnable and NON-REFUNDABLE. All monies paid such as deposits and payments are non-refundable.
You understand that your ticket or entry credential is not subject to any refund, bears no cash value, and is not redeemable for cash. You understand that your ticket is non-refundable even if you are requested to leave the Event for a possible violation of these terms and conditions or of the regulations in force at the event, if the event is terminated early or cancelled for any reason, entry conditions are modified, or force mature, including but not limited to pandemic or epidemic, natural disasters or circumstances out of the control of the Event. If you are denied entry into the country, are unable to obtain a valid passport, or are otherwise unable to attend, you forfeit your purchase and are NOT entitled to any refunds or credits.
Girlcation cannot accept responsibility for unused tickets or no shows. Tickets are considered forfeited if not used/redeemed at the event they were purchased for.
Company reserves the right to, without any prior notice or compensation to You: postpone, cancel, interrupt or stop the Event; provisionally keep visitors on the Event site at the end of the Event; totally or partially vacate the Event site; and deny access to the Event site regardless of the possession of a valid Ticket.
In the event of cancellation or rescheduling for any reason, Girlcation reserves the right of sole and absolute discretion to either partially refund, refund in whole, not to refund or to reschedule the event. If the Event Organizer approve any refunds or the option to choose between a refund or a credit, for the event; any refund and/or credit policies are determined on an event-by-event basis by the Event Organizer, and may be subject to limitations set by the Event Organizer. If the Event Organizer approves credits, we will send you a notification explaining your options, and you may submit a request. Alternatively, you may simply keep your ticket(s) to the postponed, rescheduled, or moved event. If your event is cancelled, postponed, rescheduled, or moved, we will attempt to contact you to update you on the status of the event, and inform you of any refund, credit, or exchange procedures. For exact instructions on any particular cancelled, postponed, rescheduled, or moved event, please check the event information online and in your account (which will include the most current information on the status of the event), or contact us. We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled, postponed, rescheduled, or moved event.
YOU UNCONDITIONALLY UNDERSTAND THAT ALL TICKET SALES ARE FINAL. THERE WILL BE NO TICKET REFUNDS AND/OR TICKET EXCHANGES.
EXCEPTION: You have 5 days to change your mind after booking, which gives you the option to cancel your reservation without any fees charged on our end. (Please note you may still be charged minimal non-refundable credit card transaction fees). After that 5 day period, tickets are non-refundable and all of the above terms are applicable.
 

3.2 Rain or Shine

The Event is a rain or shine event, please come prepared!
 

3.3 Covid-19 Warning

According to the Center for Disease Control and Prevention, an inherent risk of exposure to the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof  (“Covid-19”) exists in any public place where people are present. Covid-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness—including, without limitation, exposure to Covid-19 or any other bacteria, virus, or other pathogen capable of causing a communicable disease or illness, whether that exposure occurs before, during, or after the event, and regardless of how caused or contracted—and you hereby waive any and all claims and potential claims against the Event and Covered Parties relating to such risks, hazards, and dangers.
You will be attending the Event and using any facilities on-site at your own risk. We will take all reasonable measures to ensure the health and safety of our attendees and everyone legally onsite at the Event but we cannot be responsible for the behavior or health of other Event attendees and cannot ensure that no attendees will have Covid-19. Therefore, you accept that we will not be responsible should you contract Covid-19, nor for any related illness or death as a result of attending the Event.
You understand and agree that there are certain risks of personal or property injury, illness and/or death associated with attending the Event due to risks related to COVID-19. You understand and agree (a) that the risk of exposure to COVID-19 cannot be fully eliminated and is increased by proximity to other people, (b) that an inherent and elevated risk of exposure to COVID-19 exists in any public place or place where people are gathered, (c) that attending the Event may involve coming into close contact with other people, (d) that there is no guarantee, express or implied, that you will not be exposed to COVID-19, and (e) that exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, and other short-term and long-term health effects, including death. Despite these risks, you voluntarily assume all known and potential risk and danger of injury and/or death from any cause, resulting from, in connection with, or incidental to the Event, including exposure to COVID-19, and agree that the Event and the Covered Parties are not responsible for any such risks and dangers. All attendees should evaluate their risk in determining whether to attend the Event. By entering the Event, attendees voluntarily assume all risks related to exposure to COVID-19 and confirm that they will adhere to local quarantine mandates and the CDC quarantine requirements.
Where an Event is cancelled, postponed or adjusted for any reasons related to Covid-19 (including, where the Event is permitted to take place but it is not financially viable to do so), Event has the sole discretion to either offer a partial refund, full refund, NO refund, or rescheduled Event. If Government guidelines or legislation mean we have to reduce the Event capacity, regrettably, we may need to cancel your Ticket to comply with those requirements. Any such cancellations will be at our sole discretion. We will notify you as soon as possible in advance and as regards your Ticket the Event will be deemed to have been cancelled.
You should not attend the Event if any of the following apply, (a) you have tested positive for Covid-19 within 14 days of the commencement of the Event, (b) you display any symptoms of Covid-19 within 14 days of the commencement of the Event, (c) you live with someone or are in a linked household with someone who displays symptoms of Covid-19 or who has tested positive for Covid-19 within 14 days of the commencement of the Event, (d) you are otherwise required to self-isolate, or (e) your attendance would be in breach of latest government legislation or guidance relating to Covid-19 containment at the time of the Event. You agree that if Covid-19 or other related illness prevents you from attending the Event, you will forfeit your ticket and not be entitled to any refunds or credits.
You agree that, if while at the Event you display any symptoms associated with Covid-19, you will voluntarily leave the Event, and that the Event has the right, in its sole discretion, to require that you leave the Event; and in the situation where you are required to leave the Event due to exhibiting COVID-19 symptoms, you understand that no refund of any ticket price shall be provided; and that the Event has no obligation to permit you to re-enter the Event even after the passage of time suggested by the CDC for quarantining or isolating relating to Covid-19 exposure or infection.
All guests will be notified of, and obligated to comply, with all new and existing Governmental or Event terms and conditions including any and all health and safety requirements. All final decisions regarding those policies will be at the Event’s discretion. These requirements may include testing or vaccinations. Any expense incurred to comply with those policies, medical or governmental, will be at the cost of the purchaser. The Event or Covered Parties will be under no obligation to refund or credit any purchaser, in full or in part, due to expulsion, denial or delay in boarding for non-compliance with Event and Governmental requirements. This includes any and all present and future COVID-19 related policies and requirements.
We will take reasonable operational steps to comply with any relevant legislation and/or relevant Covid-19 safety guidance which apply to the Event and/or the Venue. We may instate these prior to or during the Event. We will communicate these measures to you either via our website, social media channels, onsite at the Event or via direct communication. You are responsible for ascertaining what rules are in place at the Event as regards Covid-19 and for understanding and complying with all adapted Site Rules for attendance at the Event in relation to Covid-19.
Specific Site Rules introduced for the Event as a result of Covid-19 will be compulsory for all attendees of the Event. These will prevail over any conflicting Conditions or conflicting Site Rules. Failure to comply may result in you being refused entry to or ejected from the Venue without refund. We have the right, at our complete discretion and without payment of any refund or any further liability, to refuse entry to or eject from the Venue any attendee who we reasonably believe may display Covid-19 symptoms or who may not have followed Government legislation or guidelines or otherwise be in breach of these Conditions or any Site Rules (including, but not limited to, any Covid-19 specific Site Rules).
 

3.4 Force Majeure

If the Event is cancelled in whole or in part due to a Force Majeure Event, you will not be entitled to a refund. Notwithstanding the foregoing, the Company may issue, at the Company’s sole and absolute discretion either a partial refund, full refund, no refund, or rescheduled event, by accounting for, among other considerations, the extent and nature of the cancellation. You understand that in all instances, the maximum remedy You may receive for the cancellation of any part of the Event, if any, will be the face value of Your Ticket, excluding all fees, taxes, payment plan fees, and/or service charges paid by You in connection with the purchase of Your Ticket. A “Force Majeure Event” shall mean an act of God, act or threat of terrorism, earthquake, fire/wildfire, substantial snowstorm, flood, hurricane, tsunami or other natural disaster, explosion, casualty, lockout, war, strike or other labor condition or dispute, an order or injunction of any court or administrative body or any other act of public authority (local, state and/or federal), riot or civil commotion, national state of emergency or mourning, enactment, rule, order or act of any government or governmental instrumentality (including mandate to reduce venue capacity), epidemic or pandemic (including, without limitation, Covid-19), labor controversy, strike or lockout, act of public eneyour, embargo, civil disturbance, governmental action, supply chain disruption, accidents, illness or injury of personnel, any law ordinance or regulation, legal order, any failure or delay of any transportation, power, or communications systems, severe weather threatening the safety of Event attendees or similar contingency or unexpected event, any such occurrence or event beyond the reasonable control of the Event, or for any other reason in the Event’s sole discretion, the Event may, at its election: (1) terminate this Agreement by notice to you and present you with either NO refund, partial refund, full refund, or rescheduled event, at the sole discretion of the Event. If the development and or hosting of the Event is prevented, delayed or impaired by an event of force majeure, including, without limitation to the above reasons, we shall not be deemed in default or otherwise liable under these Terms due to our inability to perform Our obligations.
 

3.5 No Warranty

All products, services, advice, merchandise and information available through this Site are provided on an “as is”, “as available” basis without warranties of any kind, either expressed or implied, including but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (a) regarding the purchase of any product or ticket, (b) that a User will receive the lowest available price for goods, tickets and/or services available through this Site, (c) that use of this Site and all software, products or services associated with this Site will be error free, uninterrupted or secure, (d) that defects or errors will be corrected. We are not responsible in any way for the accuracy or suitability of any payment of taxes to any entity on your behalf. You expressly agree that the use of this Site is at your sole risk.
 

4.1 Purchasing

When you find desirable tickets and wish to purchase them, you fill out and submit the information requested on the Site, which constitutes an order. This order is an offer to purchase the tickets. Once you submit the order, you cannot cancel or retract it. Upon the submission of the order, either a hold or an immediate transaction will be placed on your credit or debit card for the funds necessary to purchase these tickets. You will receive an email promptly after you place your order. Neither of these actions complete the sale. Rather, a completed sale is dependent on the seller's acceptance of the order and notice of confirmation to you that the order is accepted. Upon the seller's acceptance of the order, your credit or debit card used in placing the order will be charged.
It is a violation of law to purchase a product in a false name or with an invalid credit card. Please be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be prosecuted to the fullest extent of the law.
 

4.2 Processing Services

The Site utilizes a third party vendor ("Vendor”), from which it licenses a platform; additionally, Vendor performs services related to your purchase. These services include, but are not limited to: (a) processing orders, (b) verifying order details and confirming validity of payment information, (c) charging your credit or debit card, and (d) coordinating the delivery of purchased tickets. Vendor does not design or market the Site and its sole relationship with the Site owner is that of independent contractor. Vendor and Site shall collectively be referred to as "We" within these Terms.
 

5.1 Event Dates, Times and Location

Event date, times and venue may change. Event will use best effort to inform you of any such changes, however it is your responsibility to monitor the event for any changes. In certain instances, the event may require a ticket holder to relocate your seat placement, or change the seating configuration in any way the event sees fit. Girlcation or Event will not be held responsible for any such change and will not be obligated to provide a refund or any other compensation in the event any changes occur.
 

5.2 Itineraries and Lineup

Event reserves the right to cancel or change itineraries or lineup at any time. All events and Talent are subject to change.
The Event reserves the right to change, modify, or alter any aspect of the Event (including, without limitation, the appearance of any performer or artist, and/or the order of performance of any performer or artist), at any time, for any reason whatsoever, without any prior notice or compensation to You. You understand that the artists and/or lineup for the Event may be changed and that such occurrence shall not, under any circumstances, entitle You to any claim whatsoever, including, but not limited to, a refund for Your Ticket.
 

6.1 Payments

As a buyer, you grant Vendor permission to charge your credit or debit card for the purchase of tickets. Visa, Mastercard, Discover, American Express are valid payment methods for purchasing tickets. You may also utilize ShopPay, which is an independent payment method through Shopify Payments.
All information on accounts and orders must be valid and are subject to verification. Orders are subject to credit card approval, and are processed only after the billing address associated with your credit card and other billing information have been verified. Orders that are placed, or attempted to be placed, using an account with any information that is found to be false, misleading, incorrect, or incomplete, or that cannot be verified as belonging to the account holder—such as name, address, email address, phone number, IP address, or other account or billing information—are subject to cancellation, at any time. Furthermore, if your order is cancelled for any of the foregoing reasons, we may sell your tickets to another customer without further notice.
 

6.2 Currency

All ticket prices for events are stated in U.S. Dollars.
 

6.3 Order Confirmation

Your order is confirmed when we send you a confirmation, in the form of a confirmation page or email ticket (“Order Confirmation”).
If you do not receive an Order Confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via your account whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
Please check your tickets carefully once they arrive, and please contact us if you have any questions regarding the tickets you received. We may charge fulfillment, shipping, service, or other fees for using our services. We may change such fees at any time, including after you post your tickets.
If an error is found with your order, including payment amount or seat placement, you must notify us within 5 days of purchase. Any errors found after the 5 day purchase window may not be able to be remedied.
 

6.4 Payment Plans / Installments

The deposit per person is charged at the time of booking & the total remaining balance will be split into equal monthly installments automatically charged to the credit card on file with the first installment due within receipt of your invoice, usually between (1) and (30) days after your initial purchase. All tickets must be paid in full 2 months before the event starts, so payments will vary based on when you book your tickets. At the most, you are able to split your payments into 10 installments total.
Unless otherwise arranged, the same credit card used to make a payment will be used to make subsequent payments when due. If you have more than one credit card on file, please log in to make payments or alert the Event as to which card to use for automatic payments. Rates and fees are subject to availability and may change without notice. To use this service, we charge a $100 payment plan fee, per person, per event, subject to change, on top of your ticket price + taxes/fees. (taxes/fees will be calculated at checkout, and will adjust your final payment amount.) Payment plan fees are non-refundable.
 

6.5 Autopay

Your credit card on file will be charged automatically on the date listed of each month and Final Payment must be made 2 month before the commencement of the event. Guests assume responsibility to provide updated credit card information for Auto Pay.
 

6.6 Declined Payments

If your payment declines, contact Girlcation immediately. There is a $25 declined credit card fee, which will be assessed each time a payment is declined.
 

6.7 Late Payments

There is a $45 late payment fee, per late payment. If your account is in default and/or you are past due on your invoices, we have the right to cancel your ticket(s) and reservation(s). You understand and agree that if your account is in default or past due and we deem your ticket/reservation as cancelled, you forfeit any prior monies spent. We will make best efforts to contact you to resolve your late payment before canceling your ticket/reservation, however after your account has been set to cancelled, we will release your seats back to the public. If you would like to reinstate your account after cancellation, contact us immediately. Please note, your original tickets may no longer be available and you will be subject to current pricing.
 

6.8 Disputed Charges

You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to tickets you purchased. Without limiting the generality of the foregoing, you will not contact us to seek a refund or exchange from us when we are prohibited from providing one by the Event Organizer, and you will not dispute or otherwise seek a “chargeback” from the company whose credit card or other method of payment you used to purchase tickets from the Site. Should you do so, your tickets are subject to immediate cancellation, and we may, in our sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit future purchases from all persons in whose name the credit card accounts exist, and from any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site. In the event that you dispute the charges, we reserve the right to mitigate our damages by re-listing the tickets for sale. You are responsible for any and all legal fees incurred by you, Site or vendor associated with your disputed charges and chargebacks for purchases made, or tickets listed, on this Site. We reserve the right to place you on a “do not book list” if you issue a chargeback, which would mean you would be unable to attend our events in the future, unless reversing your chargeback.
 

6.9 Split Payments

When utilizing the split payment feature, all payments must be made within 3 days of receiving payment links for your tickets to be confirmed. If all payments are not received, we will either contact you to remedy and pay the balance remaining, or cancel your order and refund the other part of your purchase that was made within the 3 day window. Split payments are only available to customers paying in full at the time of purchase and will not be honored for customers utilizing our payment plan option.
 

6.10 Tax

You are responsible for paying any sales taxes or other taxes that may be applicable.
 

6.11 Service Fees, Order Processing Fees and Shipping Charges

Tickets purchased on our Site are typically subject to, among other possible fees, credit card processing fees, merchant fees, a per ticket service fee and a per order processing fee. We collect tax as required by state and local laws. We may display the tax separately or include it in the total service fee amount. In many cases, you may need to pay a shipping or delivery fee if ordering physical goods. Any shipping or delivery charges are calculated based on delivery location and shipping method. Please note that the delivery fee, as well as the order processing fee, may not reflect the actual cost to deliver or process your order, and in some cases, these fees may include a profit to the event. Service fees and order processing fees may be subject to change.
 

7. Groups

If using a group rate (10+ people) or special coupon, everyone in your party must complete their purchase for the offer to be valid. For instance, if booking with our group discount of 5% off for 10+ girls, if only 9 confirm their tickets, the group rate will not apply and you will be required to pay the 5% remaining in order to confirm your tickets. If you believe someone in your party may not be able to pay their balance promptly, we recommend either adding their tickets at a later date (while tickets last) or paying on their behalf and getting them to reimburse you. Keep in mind, tickets are not refundable, so if that person is later unable to attend, you will still be responsible for that payment.
If purchasing multiple tickets in an order, the cardholder, also known as “Lead Booker” (see below) will be responsible for the entirety of the order/reservation. If the Lead Booker is unable to complete their payment(s), the entire reservation will be cancelled without refund, despite previous monies spent. For this reason, we recommend booking large groups in separate purchases, or by contacting us directly to coordinate a large group purchase to ensure you get the group rate.
Group rates and discounts may change at any time. Currently, for groups of 10 or more, you are entitled to a 5% discount on your entire order, as long as everyone in your group is seated in the same “section”. Groups traveling together who are not purchasing tickets in the same seating section may not be eligible for the group rate, at the sole discretion and availability of the Event.
 

8. Minors

Minors are not allowed at the event and all attendees must be at least (18) years of age to enter, whether or not they have a valid ticket. By purchasing tickets, you agree that you are either (a) at least 18 years of age at the time of booking, or (b) will turn the age of 18 at least (7) days before the event commences. Any minors below the age of 18 will be denied entry and their tickets revoked without refund. You must be twenty-one (21) years of age or older to purchase and/or consume alcohol and proof of age is required.
 

9.1 Seats

Reserved seats: Your exact seats will be reserved for you the entire 3 day event, so you can come and go as you please without worrying about losing your seat placement.
Unreserved seats: If you choose a seating section with unreserved seats, you will be guaranteed a seat, however placement will be on a first come, first serve basis.
If you choose an unseated section such as GA Standing, please note that this section is standing room only and will not have seats in the main venue.
Please note that seating maps are representative of a venue’s layout; however, they are subject to change at any time, and refunds are not allowed if the seating map is updated, if additional seats / rows are added, or if seats change as a result of a venue change after purchase.
 

9.2 Changing Your Seats or Section

Currently, we do not offer section downgrades, however, if seats are available, you may upgrade sections or change your seats within the same section. If there is a pricing difference between what you paid and the upgraded section you are moving to, you will be billed the difference of the current listed prices. Moving your seats within the same section will not have an impact on your price. You can move your seats complementary within the same section up to 2 times before the event. Changing your seats 3 or more times before the event incurs a fee of $30 per additional change. If you arrive at the event and would like to change your seats or upgrade, we will do our best to accommodate you if space is available, however this cannot be guaranteed.
 

10. Prices

Prices shown on this site are per person. Tickets to the main Event include entry into the main 3-day event, and do NOT include hotels, flights, excursions, transportation, insurance, add-ons, amenities, taxes, visa fees, government fees, credit card fees, prepaid gratuities, or additional 3rd party purchases. We may offer additional add-ons, additional events or event upgrades, which you may purchase separately from your event tickets, however you may not purchase any additional event add-ons without the purchase of access to the main event. We may occasionally offer tickets at a discount after the original on-sale date, and will not refund the difference between the original price and the sale price.
 

11. Immigration

By purchasing tickets to the event, you acknowledge that you will need to obtain entry into the country of Jamaica. If you are not currently residing in Jamaica, you are required to have a VALID PASSPORT to enter the country. You may need to obtain a Visa or other documents such as health forms to enter the country. Aliens who are permanent residents must have their Alien Registration Card/Green Card in addition to their passport. All other non-U.S. passengers should contact their respective embassies or Jamaican Immigrations for applicable regulations.
Before purchasing tickets, you agree to check that your current passport’s and documents’ expiration dates are valid through at least 3 months after the event. If you do not currently have a passport, you understand that there may be significant delays in obtaining a passport, and if you are not able to receive a passport in time for the event and are therefore unable to enter into Jamaica, Girlcation holds NO responsibility and your ticket(s)/reservation will be cancelled/forfeited.
 

12. Health and Disability Notice

You agree to inform Girlcation of any existing health issues, severe allergies, physical or mental illness, disabilities or other conditions at the time of booking. If there are any changes to your medical state before the event, you will inform Girlcation. If you have any medical conditions that may cause you to lose consciousness, you will at all times wear a medical alert bracelet, and/or have an aide/representative who is aware of your medical condition, medications and any other sensitive information pertaining to your health.
 

13. ADA Accommodations

If you will require special assistance at the event or need wheelchair accessible seating, please contact us PRIOR to booking your tickets. We have special reserved seats/sections which are wheelchair accessible, which are not available to purchase online without a special ticket link. Please note that the country of Jamaica has different laws regarding disabilities than the USA or Canada, please do your research based on your specific disability to ensure proper sized wheelchairs, aids or service animals will be admitted prior to your trip. We do our best to accommodate all types of disabilities, so please don’t hesitate to contact us with any questions or concerns.
 

14.1 Medical Waiver and Release

In the event of a medical emergency, you hereby consent to medical care and transportation at your cost in order to obtain treatment that is deemed reasonably appropriate or necessary by the reasonable discretion of the Event staff, security, police or medical professionals.
You hereby agree to release and not hold responsible the Company from any liability arising out of, or in connection with, the actions or omissions of the Company related to your medical care.
You recognize and acknowledge that there are hazards and risks of physical injury or illness and that not all such risks can be fully eliminated.
You understand this waiver extends to any liability that arises out of, or is in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury.
Participants at the Event may seek first aid services. You understand that at the Event, first aid services may be provided by personnel who may not be medical doctors, and will make suggestions only. You assume all responsibility for the decisions you make concerning your health care or in response to suggestions for first aid by personnel at the Event. You consent to have medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Event, and you authorize the Event and its designated agents and any first aid personnel at the Event to administer emergency first aid, CPR, use any necessary medical devices, and secure emergency medical care or transportation, if deemed necessary by the Event or its designated agent and you agree to be responsible for the payment for all costs of emergency medical care and transportation. You hereby release the Event, the Covered Parties, and any and all persons participating in the provision of wellness, first aid, or any medical treatment to you at the Event, from any responsibility or liability relating to providing suggestions to you concerning first aid, for your decisions about what type of wellness, first aid or medical aid to utilize, and for any emergency first aid that is provided to you.  In addition, you acknowledge it is your sole responsibility to provide any medical information regarding any pre-existing conditions you may have, medications you may be taking, or other key treatment-related information to Girlcation and Event and any medical staff at the Event. If your condition could result in your losing consciousness at any time, you must also at all times wear a medical alert bracelet or other condition identifying marker commonly known to medical professionals in order to aid in their treatment of your condition. Failure to do so will be determined to be negligence on your part in connection with any medical event.
 

14.2 Acknowledgment of Risks and Dangers

By entering the Event site, you voluntarily agree to assume the full risk of death, bodily injury or property damage, regardless of severity, that may be sustained as a result of attendance at the event or while on the premises, whether or not caused by the negligence or gross negligence of the Event or Venue.
By entering the Event, you assume any and all risk and/or danger, known or unknown, foreseeable and unforeseeable, resulting from, or incidental to, the Event, whether occurring prior to, during, or subsequent to the Event, including, but not limited to, any death, personal injury or loss, damage or liability whatsoever. You understand that your use of your ticket is contingent upon your voluntary assumption of the risk and danger that may result from, or be incidental to, your presence at the Event, whether occurring prior to, during or after the Event, including any actions or omissions of the Event Parties.
By entering the Event, you acknowledge and agree that you may be subject to extremely loud music and sounds, as well as special effects, including, but not limited to, laser lights, strobe lights, flashing lights, a variety of light emitting diodes (“LED”), rapidly changing or alternating images, and use of smoke, fog, and pyrotechnics (collectively, the “Special Effects”) at the Event.
You acknowledge and understand that the Ticket is a revocable license to attend the Event for which it was issued, and is subject to revocation and denial of admission without compensation for any reason, including, but not limited to, your attempted or actual violation of any of the rules set forth herein, policy or regulations and for any other action taken by you in violation of any local, state or federal law, or that may endanger other Ticket Holders.
You understand and acknowledge that (a) activities at the Event have inherent dangers that no amount of care, caution, instruction or expertise can eliminate, and pose substantial risks of physical injury and/or death, disease or illness and/or damage to or loss of personal property; (b) the Venue is located in a foreign country and speedy medical attention may not be available, if at all; (c) there are inherent risks of slips, falls, hazards, wildlife, careless behavior by you or other attendees. You expressly and voluntarily assume all risk while participating in the Event and in any activities, whether or not caused by the negligence of the Event and any of its owners, directors, employees, representatives, agents, contractors or volunteers (collectively, the “Covered Parties”), and agree and acknowledge that your participation in the Event and any of the associated events or programs is of your own free will and completely voluntary. You acknowledge and accept any and all risks and dangers can occur and accepting this agreement means that you accept the risk.
 

15.1 Conditions of Entry / Entry Requirements

Valid ticket and valid matching ID are required. Please note that there may not be tickets available for purchase on site, and tickets must be purchased in advance on our site to guarantee entry. If the event is listed as “Sold Out”, no tickets will be available at the site or venue, and you may sign up for our waitlist online to be notified if additional tickets become available. There will be no loitering or waiting for tickets if an event is listed as “Sold Out”, and if tickets are available on site, they will be sold in a first-come, first-serve manner.
No ID, no entry. Your ID MUST match the name on your reservation/ticket or you will be denied entry. Only acceptable forms of ID must be a CURRENT version of one of the following; Passport, Driver’s License, Government ID card or Armed Forces card. Screenshots of any form of ID or Student IDs will NOT be accepted. You MUST also have a valid passport to enter into the country of Jamaica, unless you are a current resident on the island.
 

15.2 Zero Tolerance Drugs Policy

Absolutely no illegal drugs allowed on site. Anyone who is believed to be under the influence of illegal drugs will be removed from the premises and their tickets revoked without refund. Anyone using, selling, distributing or possessing any illegal drugs will be handed over to authorities, and will be subject to any and all laws applicable. Notwithstanding the foregoing, you are permitted to bring into the event your own prescription drugs if you have a valid prescription with your name clearly listed on the bottle. You are only allowed to carry the dosage required to take during the duration of that day at the event. At any time, if someone is believed to be in violation of this policy, they may be searched by security. By entering the Event/Venue premises you hereby agree to this zero tolerance drug policy to create a safe space for everyone attending the Event.
 

15.3 Security Check

All attendees are subject to a security check/search before entry. By entering the Event site, You consent that you and your belongings will be searched by Event staff. If You refuse to submit to a search by Event staff, You will be denied entry to, or ejected from, the Event site. This may include metal detectors, bag search, drug sniffing dogs, pat downs or other security measures. Entry may be denied to anyone who is under the influence of illegal drugs/substances, are heavily intoxicated, are found to have prohibited items, or refuse a security check. If security deems an attendee to be a security threat, they will be denied entry or removed from the Event, may have their ticket revoked without refund and may be subject to police involvement.
 

15.4 Prohibited Items

Any and all prohibited items found may be seized and/or the attendee denied entry. Prohibited items include, but are not limited to; weapons of any kind (or anything that could be used as a weapon), illegal drugs or substances, prescription drugs not in the name of the attendee or above the allowed limit, personal alcohol, professional photography/audio/filming equipment, animals (except registered service animals, pursuant to local regulations), drones, fireworks or flares, laser pens or laser pointers, pocketknives, fuel, spray paint or other paint, stickers, unauthorized promotional material, speakers, flags, large umbrellas, signs or posters larger than 24” x 24”, scooters or bikes (unless for a disability), tripods or monopods, outside food or drinks, luggage, bags larger than 24” x 12”, credit card machines, aerosols/aerosol cans, artificial noise makers, obscene clothing that may cause a disturbance to the other attendees, and any other items deemed as posing a threat to the safe enjoyment of the event.
 

15.5 Code of Conduct

You agree that you will comply with all applicable laws, rules and regulations. No smoking is allowed on property unless in an outdoor designated smoking area.
This event operates with a zero tolerance violence policy. We expect all of our attendees to abide by and conduct themselves in a respectable manner. Verbal threats, repeated foul language, pushing/hitting/poking/grabbing of any kind, hate symbols, throwing any items onstage or any other violence will result in immediate removal from the event and revoking of tickets without refund. Any violence that is deemed unlawful will involve local authorities.
Attendees may not display or make texts, symbols, images, gestures, wear clothing or articles of dress which, in the sole discretion of Event staff or security personnel, contain and/or display language and/or images which are obscene, racist, xenophobic, provocative, hate speech or discriminatory.
Attendees will not disturb the peace, demonstrate an intent to disturb the peace or provoke someone else to do so, or compromise the safety of the general public. Attendees will not deface, mark, damage, tear down or otherwise destroy, in whole or in part, any of the decorations, infrastructure or part of the Event site or Venue, Litter or fail to maintain the cleanliness of the Event site, Throw or shoot any object or liquid, or throw or shoot any other product in loose or gaseous form, Obstruct entrances, exits and evacuation routes and/or to linger at these locations any longer than strictly necessary for entering or exiting the Event site, Climb tents, constructions, fences, closures, lighting columns, tables, benches or any other infrastructure of the Event site. At the Event, it is forbidden to try to access sections restricted to artists or Event staff – such as production rooms, green rooms, press rooms, offices, backstage and working areas – unless in accordance with your ticket or credentials. Trying to access these areas may result in your removal from the event and/or exclusion from future events. 
Attendees will follow and heed all posted or otherwise written and verbal instructions from event or venue staff and security personnel at all times whilst on the event site, including current Cover-19 health protocols that may be in place. We ask that you treat the venue, other attendees, performers/artists and staff/crew with kindness and respect, and please do your best to clean up after yourself before leaving the venue.
 

15.6 Wristband Policy

All tickets will be exchanged for a Wristband - This wristband is your only access to the event. DO NOT TAKE IT OFF FOR ANY REASON!
You are not allowed to share Wristbands with anyone, at any time, and wristbands must be worn by the ticket holder only. Wristbands must be worn at all times throughout the Event. You understand that wristbands are void if tampered with or removed. No exceptions. You will contact staff immediately if you break your wristband.
Once you purchase your ticket you will receive an order confirmation email from Girlcation, then following in a separate email will receive a ticket link from either Girlcation, Evey Tickets or a similar ticketing service on behalf of Girlcation, which will serve as your ticket confirmation until attending. At the event, you will exchange your printed ticket or scan your mobile ticket in exchange for your wristband/credentials at Will Call upon arriving/checking in at the Event and validating your ID matches your ticket/reservation. You will not be allowed to enter the event unless wearing your own, valid wristband. Event wristbands or credentials must be worn at all times and must not be tampered with. Tampering with your wristband may deem it void and result in you being removed from the Event or required to purchase a new ticket. If you lose, break or misplace your wristband or credentials you will be subject to a minimum $100 daily fee, or you may need to purchase another ticket to enter the Event.
 

15.7 Re-entry

Unless otherwise stated or revoked, your ticket/wristband will be valid for the entire 3-day event. You may enter and leave the event site/venue as many times as you want, during the hours listed on your ticket. Please note, you must scan your ticket/wristband upon entering and leaving, otherwise your ticket may register as “currently in use”, and you may be denied re-entry.
If You are removed from the Event, Your ticket shall not be refunded and You will be denied re-entry, even if You are in possession of a new Ticket. If You have a new Ticket, Event staff may seize that Ticket and You shall not receive a refund.
 

16.1 Merchandise and Vendors

Official T-shirts and other Event souvenirs are only on sale at the event or on our website. Unless you have received written permission from the Event, or are a registered vendor acting within your booth, you may not sell or distribute any items at the Event. Unauthorized sale of goods at the Event may result in your removal from the Event. All merchandise purchases are final, and in no event will there be refunds, exchanges, or credits for merchandise purchases. Purchases made with any 3rd party vendors at the event are sold independently, and must be done at your sole discretion. We are not responsible in any way for the purchase, consumption, warranty, refunds, quality or delivery of any products purchased through 3rd party vendors at the event site.
 

16.2 Parking

The Event disclaims all responsibility from losses or damages to vehicles parked in or near the Event. The Event is not responsible for losses or damage to any vehicle on or near the Event, including, without limitation, vehicles towed from the Event site.
 

16.3 Shuttles

Shuttles to and from the Event are operated and owned by 3rd party vendors, and Event retains NO responsibility for the companies, agents, drivers or vehicles of said “Shuttles”. Shuttle access is provided only for ease of attendees and is in no way related to the event or its organizers or companies. Any incidents, accidents, delays, changes or cancellations of shuttles or shuttle service is in NO way the responsibility of the Event or related parties. Event is in NO way responsible for any injury, death, loss, claim or damage pertained in relation to the shuttle service.
 

16.4 Hotels, Excursions and Transportation / 3rd Party Vendors

Event is not responsible for any air or ground transportation to the Event site, travel agencies, insurance, hotel accommodations, nor would Event be responsible for any transportation cost incurred under any circumstances. Event does not sell hotel rooms, excursions or transportation, however we may have recommended links / companies listed on our website(s). All purchases from 3rd party vendors must be done so independently. Event is not responsible for any conditions, damages, injuries, death, accidents, delays, changes, cancellations, fees, fraud, or loss with any 3rd party vendor, even if vendor was recommended by Site or Event. You accept all responsibility for these vendors and book/use their services at your own discretion. Please only book reputable services, hotels or excursions. If you are booking with an independent company, be sure they are accredited, take the payment method you prefer, and make yourself aware of any policies they may have.
 

17.1 Photography / Recordings

PERSONAL USE ONLY. Specific rules apply to the area in which you take photos or video (see below). Attendees may take photos and shoot video for personal, non-commercial use, with personal cameras (excluding SLR/DSLRs) as long as they are not standing in the press area, obstructing views, using any sort of device like a tripod or selfie-stick. Any recordings made by ticket holders on or near the Event site may not be used for commercial or public purposes, unless consented to by the Company. (including, without limitation, having ads run on or beside such videos on YouTube and other video sharing websites, posting to any website or blog that runs ads or sells products). The Event monitors the dissemination of Event Imagery to protect participants’ rights to privacy and freedom of expression to ensure that Event Imagery are used only for “Personal Use.” This means that Event Imagery cannot be used for non-personal purposes, such as advertising or commercial purposes, magazine articles, or news articles. “Personal Use,” is defined to include; displaying on personal accounts on photo sharing and social networking websites, such as Instagram and Facebook / other social media accounts (as long as said accounts are not monetized and you or another party do not benefit financially or by trade in any way, for example gaining money from brands because of attendance to the event, the display of the Event Imagery on these sites is not commercial or promotional in any manner, or the account is not affiliated with any commercial enterprise), sharing with friends and family, posting to a personal blog, displaying on personal websites (as long as the website does not sell any product or service, and does not claim or appear to be an official website of the Event.); Provided however that in any such display of images, the use will be considered “Personal Use” only if the group of followers or website visitors is not inordinately large, which shall be determined by the Event in its sole discretion. In any dispute between us, you agree that the Event may determine, in its sole discretion, whether any use of Event Imagery is for Personal Use or not. You understand and agree you may not make use of Event imagery without prior written permission from the Event, other than Personal Use. You understand that you have no right to sell, transfer, license, sublicense, or give your Event Imagery to any other party, except for Personal Use, and you agree to inform anyone to whom you give any Event Imagery that it can only be used for Personal Use. You understand that you may not use or allow to be used any Event Imagery in any media article, newspaper article, video, blog, advertisement or promotional materials, except with the prior written consent of the Event. You understand that if you record Event Imagery with the intention to utilize it for non-personal use, you will be trespassing, and that trespassers have no rights to any use of Event Imagery, and the Event reserves the right to take any necessary action against trespassers. You understand that the Event has no obligation to grant written permission to any person under this Paragraph, and that the Event may deny any request for use of Event Imagery in its sole discretion. If you post, or allow to be posted, any Event Imagery on a personal website or a website controlled by a third party, even if permissible as Personal Use, you agree that you will place, or cause to be placed, on any webpage on which such Event Imagery is displayed a notice that the Event Imagery can be used only for the poster’s Personal Use (as defined above) and not for any other purpose, and the Event Imagery may not be downloaded or copied. You will not post or license any Event Imagery that contains any nudity or partial nudity (including any imagery in which bare breasts, bare buttocks, genitals, or genital areas are visible) and if Event or Girlcation notifies you that any images must be removed, for any reason whatsoever in Event’s sole discretion, you will promptly remove or cause to be removed those images. You grant Girlcation the right, as your agent-in-fact, and under your authority to revoke any Creative Commons or other license that was erroneously placed on Event Imagery in violation of these Terms and Conditions and to cause the removal of such Event Imagery on any webpage on which it is displayed. You understand that use of the Creative Commons licenses does not supersede these Terms and Conditions, nor your responsibility as the photographer or videographer to obtain all necessary permissions from subjects and artists as appropriate.
In any situation where photographs or videos are permitted to be taken, the attendee taking photos or videos (other than an authorized Media photographer or videographer) is required to ask for and obtain consent of any person who may be included in the photographs or video. Since a participant who has granted consent in a specific situation is entitled to change her mind in a different situation, a photographer should request consent in each situation of every participant involved, even if that participant had previously granted consent in a different context. you understand that you will seek and obtain clear and informed consent of any participants before photographing or filming them, if you are asked to stop filming, you will do so immediately, you have the responsibility not to interfere with the immediate experience of other participants, and if any of your images violates the privacy or other rights of another participant you will not display that image in any public manner.
Non-professional grade small video cameras, cameras and phones are allowed at the Event site. All photographers using professional equipment (ie DSLR / anything with a detachable lenses / cameras taking footage at or above 4K) are required to have Media credentials to take pictures or video at the Event. DRONE use is STRICTLY prohibited. Selfie sticks and tripods are not permitted for use except by Media. Unauthorized photography or audio/video recording of any performance at the Event is strictly prohibited.
At the event site: Video and Photos are permitted, for personal use only. (See above)
Inside the venue: Video and flash photography is always prohibited during shows. As a general rule, photography is prohibited during shows, however, photos may be taken during specific performances and may be prohibited during others. You must follow the directions of the verbal, posted or written instructions from Artist, Artist team, Announcers, Event Staff or Security at all times. If you are told to not take photos during a specific performance, you must immediately cease photography and put your device away. If you are caught using a device after being told not to, your device may be confiscated and held by security until the performance is over, or you may be asked to leave.
 

17.2 Media / Filming and Recording Notice

PLEASE READ THIS IMPORTANT NOTICE REGARDING RIGHTS YOU ARE GRANTING BY ENTERING THIS FACILITY

This event is being filmed, videotaped and streamed. Each person entering this site acknowledges and agrees that by entering this site, he or she consents to being recorded, filmed and photographed and has granted permissions to the Event, Girlcation, its designees, licensees, successors and assigns, to depict or otherwise use (without any financial or other compensation whatsoever) his or her image, likeness, voice, and actions as embodied in such photographs(s), recordings, film and/or video and to display, transmit, exhibit, or otherwise exploit the same in any languages, formats and media whatsoever, whether now known or hereafter devised throughout the universe in perpetuity, and all rights, title and interest therein (including all worldwide copyrights therein) shall be the sole property of the Event and Event’s related companies, free from any claims by attendee or any person deriving any rights or interest from attendee. Girlcation, the Event, and any parties that they transfer rights to, has the exclusive right to include photographic, video and other visual portrayals of attendee in any pictorial medium of any nature whatsoever.
You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to us, the Event Organizer(s), our partners, licensees and assigns, including but not limited to our brand and media partners, to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
By attending the Event, You understand, agree and acknowledge that (a) You may be photographed and filmed, and (b) You hereby provide the Company with Your absolute, express consent to be photographed and filmed. You further understand and agree that these images and/or recordings can be registered, stored, transmitted, broadcast/streamed, rebroadcast, and sold for archival, promotional, and/or commercial purposes, in any manner, and in any media, now known or hereafter discovered, without any compensation to You. Your name, image and/or Your likeness may be captured as part of and/or used in connection with any broadcast/stream, audio, visual, or audio-visual recording, photograph, or other reproduction or other publication of the Event (the “Footage”) and may also be used by or on behalf of the Company or any of the Company’s parent entities, subsidiaries, affiliates, partners, sponsors, officers, owners, artists, shareholders, successors or assigns for any purpose, including, but not limited to, archival, promotional, and commercial purposes, without any compensation to You. You waive all other rights in and to the Footage, including, but not limited to, all claims of so-called moral rights. This Footage may be used to identify and facilitate the prosecution of illegal or impermissible conduct. This personal release is binding upon each such person’s heirs, successors and assigns. Any photography or video taken at these events by attendees, whether in digital or analog format, is subject to a mandatory, non-exclusive license to the Event and related Companies for use in promotional purposes. Media will be identifiable with credentials such as wristbands, lanyards, t-shirts or other identifying objects.
At the Event, there will be camera surveillance for the purpose of ensuring the safety and proper operation of the Event. The Footage may be registered or stored by the Company or governmental authorities for the purpose of ensuring the security and safety of Event attendees and the enforcement of and compliance with the safety regulations on the Event site.
 

18.1 Tickets

To enter the Event, You must have Your own valid Ticket and present a matching valid ID listing the exact name on your ticket. One (1) Ticket is required per attendee and will only be valid on the day(s) and time(s) of the Event and area(s) of the Event as indicated on the Ticket. Your Ticket is not redeemable for cash. There will be no replacements for Tickets that are lost, stolen, destroyed or damaged and You unconditionally accept the risk of damage to, loss of and/or theft of Your Ticket. Tickets are identity-based, and individuals will be permitted to enter the Event grounds only if the name on their identification matches the name on record for the ticket they are holding. Tickets may not be resold (see below).Your Ticket is intended for You only. In no instance shall You share Your Ticket with any person(s) attending or attempting to attend the Event. If You are discovered to be sharing Your Ticket with another person(s), Company reserves the right, in its sole discretion, not to grant You access to the Event or eject You from the Event.
You acknowledge and understand that the Ticket is a revocable license to attend the Event for which it was issued, which is subject to revocation, modification and denial of admission without compensation for any reason, including, but not limited to, Your attempted or actual violation of any of the rules set forth herein, policy or regulations and for any other action taken by You in violation of any local, state or federal law, or that may endanger other ticket holders.
 

18.2 No Ticket Resales / Unauthorized Sale or Use of Ticket

Currently, the ONLY place to buy tickets to the Event is directly through our sites (www.girlcation.com OR www.girlcationjamaica.com). Anyone claiming to have tickets for sale who are not having you purchase directly through our site are not authorized sellers and may not have anything valid to sell you, and we ask that you report them to us immediately. Occasionally, we may add other sites or ways to purchase tickets, so please check back here to check if the site is authorized before purchasing. Tickets purchased from unauthorized sales channels (e.g., scalpers or resale sites) or third parties may be forged, and in this case would not be honored.
You may NOT re-sell/transfer your tickets to any other party. Your tickets/reservation/wristband are valid ONLY for the lead booker/ticket holder. You must show a valid photo ID that matches the name on your ticket/reservation at the time of check in to be admitted to the event and issued your wristband/credentials. Any attendee unable to provide matching photographic ID to their ticket will be refused entry. If you need to transfer your tickets to a different name or person, please see “Ticket Transfers” below.
Anyone caught forging entry tickets or any other special admission tickets to access or sell such tickets to the Event will be prosecuted without exception. Counterfeit tickets will not be honored or refunded by the Company and Your purchase of such ticket(s) is not binding on the Company whatsoever. Anyone caught tampering with or sharing their Ticket will be immediately ejected and banned from the Event. The resale, attempted resale, or purchase of Your Ticket at a price higher than the official purchase price from the authorized ticket agent, or other Company-authorized sale channels, is grounds for seizure and cancellation of Your Ticket without compensation. The only valid tickets are those purchased and/or redeemed through the official sites or other Company-authorized sale channels listed on the official Company website. The Promoter and Event reserves the right to invalidate any ticket believed to be sold on for personal gains. Any Tickets advertised for any commercial or promotional purposes (e.g. competition prizes; in hospitality, travel, accommodation packages) without our written approval shall be cancelled and invalidated without refund.
 

18.3 Ticket Purchase / Lead Booker

When booking your tickets, you must do so by using your legal name. Tickets are identity based and proof of identity in the form of a valid ID will be required for entry.
When purchasing multiple tickets, the person who pays the initial deposit on the reservation is considered the “Lead Booker”. The lead booker is responsible for the entire payment of the reservation, whether or not the lead booker has made arrangements with others in their group. If the lead booker is unable to fulfill the payments required, the entire reservation may be cancelled, without refund. If someone in your party/group is unable to attend, you will still be liable for their ticket. The lead booker will also be responsible for receiving all correspondence from the Event. Other attendees may not receive the same information as the Lead Booker. If anyone in your group/reservation is found to be in violation of these terms and conditions, is asked to leave the event, or has their tickets revoked for any reason, you understand that the entire reservation may be cancelled without refund, and your entire group may be held responsible.
We ask that the lead booker is aware of this highly important information, and if she/he is not comfortable with these terms, have someone else in your party be the designated lead booker.
 

18.4 Ticket Transfers

If you need to transfer your tickets to a different name or person, you must do so at least (30) days in advance to the Event, by contacting us directly. Any changes within (30) days of the event may or may not be able to be accommodated. Each name change will be subject to a $100 change fee, to be paid before issuing the change. Your change request will only be valid after receiving confirmation from Event staff by email. A new ticket will be issued to you with the new name, and your original ticket will be invalid. The name/person taking the original ticket will thereby be responsible for the remainder of payments due, if any, and will need to update the ticket information to insure they receive any and all correspondence from the Event.
If you are interested in transferring your tickets to a different event/location with us, fees may apply, depending on when the original event you are booked for is scheduled. This fee is considered a restocking fee, and note that the closer to the Event, the less likely we are able to re-sell your tickets. (180) days or more, no transfer fee; (120) days or more, transfer fee of 25% of your ticket price; (90) days or more, transfer fee of 40% of your ticket price; (60) days or more, 70% of your ticket price; (30) days or more, 80% of your ticket price. Less than (30) days, no transfers allowed. You may also request a credit to another one of our events, if you have not decided which event you would like to attend or do not see an event that suits your liking announced/on sale yet; your account would then be listed as “transfer pending” with a ticket credit equal to the amount you paid for your original event’s tickets, minus the above transfer fees based on when you notified us of your requested transfer. Your “transfer pending” credit will only be valid for use and attendance of an event within (3) years, at which time your credit will be void and you forfeit any monies spent. You must notify the Event PRIOR to booking that you would like to use your credit, and a unique code will be generated for you to redeem your “transfer pending” credit on the event of your choice, OR, event staff may be able to book your ticket to the new event for you. Notifying staff AFTER booking a new reservation and paying with a credit card may mean your ticket is unredeemable on that reservation, or you may be subject to additional processing fees. Your “transfer pending” credit is ONLY valid for the names and persons on the ORIGINAL reservation. Transfer pending credits are not able to be combined with any other promotions.
 

18.5 Credits

The Event may provide the option to request a credit to an attendee for any reason, as a customer appreciation bonus, as a complimentary upgrade, or for cancelled, postponed, rescheduled, or moved events; if so, we will send you a notification, and you can submit a request for credit in your account. You must respond within (14) days, or sooner if specified in the email or notification, to be eligible for the credit offered to you; any responses or credit requests after this date may not be eligible. Credits may be applied toward the purchase of eligible event tickets, upgrades and ancillary purchases or add-ons, during the timeframe specified by the Event. Credits cannot be used for resale tickets, third-party tickets, ticket insurance, or gift cards. The Event will determine which future events, venues, and ancillary purchases are eligible, as well as the amount of the credit. You will NOT be entitled to any refunds or credits above your original ticket price, including fees (including payment plan fees, service fees, credit card processing fees or any other fee on top of your ticket price), taxes, or any other costs incurred by you to attend the event (including but not limited to airfare, ground transportation, change fees, hotels, excursions, insurance or any other related travel costs). Once you’ve requested to receive credit and we’ve verified your order is eligible for credit, we’ll either (a) send you a credit code which you can use for eligible purchases, along with instructions for redeeming that credit, or (b) put your account into “transfer pending” (see terms above under Ticket Transfers). Please note that credits typically have an expiration date, and must be used before that date; you will be notified when the expiration date is at the time of receiving your credit. Credits are non-transferable, may not be sold, are not redeemable for cash, and may not be combined with other promotions.
Please note that, if the Event offers you a choice of either a refund or a credit, whatever selection you make (i.e., refund or credit) will apply and your decision will NOT be able to be changed later. Any and all requests for a refund or credit are final and cannot be changed once initiated. You may NOT request a refund from a credit; a credit is not to be redeemable in any cash value whatsoever.
 

18.6 Tickets for Others

If you are obtaining tickets and/or entry credentials for, or providing any tickets and/or entry credentials to, any other person(s), you recognize that you are acting as that person’s agent in obtaining the tickets and/or entry credentials, and due to this agency relationship, you agree to these Terms and Conditions on behalf of any person to whom you deliver any of the tickets and/or entry credentials you obtain, and you shall notify any such person of these Terms and Conditions when you deliver a ticket and/or entry credentials to them. If you have obtained a ticket and/or entry credentials from another person, you also agree to these Terms and Conditions when the ticket and/or entry credentials are delivered to you from your use of this product or ticket, including any claims for personal injury and/or death will be governed by the laws of the State of California, and exclusive jurisdiction thereof will be in the state court residing in the county where the alleged tort occurred or federal court of the State of California. You agree that you are unable to purchase tickets for anyone under the age of (18). As the lead booker (see above) you agree that you are solely responsible for everyone in your reservation both monetarily and on site at the event.
 

18.7 Delivery of Tickets

In most cases, tickets will be delivered by the method and timeframe designated in the ticket listing. In all cases, VENDOR reserves the right to deliver tickets for any order as late as one (1) hour prior to the event. Valid delivery services on the day of the event may include, in VENDORS sole discretion, Will Call at the venue box office, email (when applicable), or pick up at a location outside the venue designated by VENDOR. Delivery designations, such as "e-Tickets" or "Instant Download", do not constitute guarantees of delivery any sooner than the day of the event. Typically such tickets will be delivered as designated. However, in some cases, delivery may first require additional verification or be subject to delays on behalf of the seller. It is your responsibility to contact us if you do not receive tickets within 48 hours of the event. Failure to do so may disqualify you from receiving a refund for any ticket you claim was not delivered, unless failure to receive notice is waived by us in our sole discretion. Only Tickets purchased from our authorized ticket agents or authorized Sites (see above) are valid and will allow admission to the Event. Tickets bought from an unauthorized third party will be void and may be seized or cancelled without refund or compensation. Price and availability information for Tickets and upgrades or add-ons is subject to change without notice.
Please keep your tickets in a safe place. We are not responsible for lost, stolen, damaged or destroyed tickets and are under no obligation, and, in many instances, are not able, to replace the tickets. If you would like to submit a request to re-issue of tickets, the reissue fee is 10% of the order total (maximum of $100 per day of the event). If for whatever reason, we are unable to re-issue the tickets, you will be refunded the reissue fee.
 

18.8 Purchase Policy

If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale, authentication, delivery, payment, or remittance process, or any other process, or if we are no longer able to verify or authorize your credit card or bank account information, your tickets may be cancelled, we may refuse to honor all pending and future ticket purchases made with those credit card or bank accounts and/or via any online accounts associated with those credit card or bank accounts. We may also prohibit you from using the Site.
We may impose conditions on your use of any coupon, promotional code, credit, or gift card. You will pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the price(s) in effect when such charges are incurred, including any applicable taxes. You may only use credit or debit cards, gift cards, or vouchers that belong to you or to people who expressly authorize you to use such payment methods. You may not attempt to conceal your identity by using multiple Internet Protocol addresses or email addresses, or by any other means, to conduct transactions on the Site. You will not hold us liable if you do not comply with laws related to your transactions. We may provide law enforcement with information you provide to us related to your transactions to assist in any investigation or prosecution of you.
 

19.1 Account Registration

You may browse the Site without registering for an account. You will be required to register for an account to use certain features of the Site, such as reserving or purchasing a ticket. Your account username may not include the name of another person with the intent to impersonate that person, or be offensive, vulgar, or obscene. Your account username and password are personal to you. You will be responsible for the confidentiality and use of your username and password, and for all activities (including purchases) that are conducted through your account. You may not transfer or sell access to your account. We will not be liable for any harm related to disclosure of your username or password or the use by anyone else of your username or password. You may not use another user’s account without that user’s permission. You will immediately notify us in writing if you discover any unauthorized use of your account or other account-related security breach. We may require you to change your username and/or password if we believe your account is no longer secure, or if we receive a complaint that your username violates someone else’s rights. You will have no ownership in your account or your username. We may refuse registration, cancel an account, or deny access to the Site for any reason.
 

19.2 Copyright / Trademark

The Site and VENDOR platform, including all Site software, databases, trademarks, logos, service marks, proprietary information and materials (and any intellectual property and other rights relating thereto) ("Our Property") is owned or licensed by Site and/or Event and will remain the property of the same. Reproductions or storage of information or works retrieved from this Site, in all forms, media and technologies now existing or hereafter developed, is subject to the U.S. Copyright Act. You acknowledge and agree that you do not acquire any ownership or licensing rights by using the site. You may not use any of our Property in connection with any product or service that is not offered by Site or Event in any manner that is likely to cause confusion with respect to Event’s or Site's business, or in any manner that disparages Site or Event. Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Our Property without the express written permission of Site or Event. The violation of applicable Intellectual Property Laws may give rise to civil and/or criminal penalties.
The registered and unregistered trademarks, logos, and service marks displayed on the Site are owned by us or our licensors. Product and company names identified on this Site may be the trademark, trade name, service mark, logo, symbol or other proprietary designation of a third party. The use on this Site of any name, trademark, trade name, service mark, logo, symbol or other proprietary designation or marking of or belonging to any third party, and the availability of specific goods or services from such third party through this Site, should not be construed as an endorsement or sponsorship of this Site by any such third party, or the participation by such third party in the offering of goods, services or information through this Site.

We prohibit the use of the Site or Event for any unlawful conduct. All users and attendees at Events must comply with all local, state, federal and international laws, ordinances and regulations. By using this Site, you agree not to use any false personal information or use an invalid or unauthorized credit or debit card. You agree not to use or permit anyone to use information provided through the Site for any unlawful or unauthorized purpose.
 

19.4 Site

Site or Event has the right, in its sole discretion, to modify, suspend or discontinue any part of this Site at any time, with or without notice. We, in our sole discretion, with or without cause, and without prior notice, may terminate your access to the Site.
 

19.5 Links / Third parties

The Site contains links to other websites that may not be owned or operated by us. The fact that we may link to those websites does not indicate any approval or endorsement of those websites. We have no control over those websites. We are not responsible for the content of those websites, or the privacy practices of those websites. We strongly encourage you to become familiar with the terms of use and practices of any linked website. Your use of other websites is at your own risk, and is subject to the terms of those websites. It is up to you to take precautions to ensure that whatever links you select or software you download (whether from the Site or other sites) is free of viruses, worms, Trojan horses, defects, and other items of a destructive nature. You agree that by using this site or purchasing tickets, you are over 18 years of age. We strongly encourage all parents and guardians to monitor their children’s internet use.
 

20.1 Limitation of Liability / Release and waiver of liability

In no event will the Event, including its Company, its parent, affiliates, subsidiary companies, officers, directors, employees, representatives, owners, members, trustees, agents, successors and assigns, venue, Girlcation, event organizers, suppliers, advertisers, sponsors, performing artists, including each of their respective management, agents, staff and designees (collectively, the “Covered Parties”) be responsible or liable to you or anyone else for any injury, death, loss, cost, claim, damage, act of God, accident, delay, or any special, exemplary, punitive, incidental or consequential damages of any kind, and you hereby knowingly and expressly waive all rights to seek, direct, indirect, incidental, special, or consequential damages of any type, and any rights to have damages multiplied or otherwise increased, arising out of or in connection with the Event, the site, the content, or any product, ticket or service purchased through the site, even if we have been advised of the possibility of such damages, and regardless of whether the claim is based in contract, tort or other legal or equitable theory.
You hereby waive, discharge, hold harmless and covenant not to sue the Covered Parties from any and all liability arising out of or in connection with the Event, for any claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or experiences of whatsoever kind, nature, or description arising out of, or related to the Event, your attendance at the Event, or your travel to and from the Event, whether or not caused by the negligence or gross negligence of the Covered Parties.
For safety reasons, the Event reserves the right to, without any prior notice or compensation to you: (a) postpone, cancel, interrupt or stop the Event; (b) provisionally keep visitors on the Event site at the end of the Event; (c) totally or partially vacate the Event site; and (d) deny access to the Event site regardless of the possession of a Ticket.
The Company reserves the right to change, modify, or alter any aspect of the Event (including, without limitation, the appearance of any performer or artist, and/or the order of performance of any performer or artist), at any time, for any reason whatsoever, without any prior notice or compensation to You. You understand that the artists and/or line up for the Event may be changed and that such occurrence shall not, under any circumstances, entitle You to any claim whatsoever, including, but not limited to, a refund for Your Ticket.
Without limiting the foregoing, you expressly acknowledge and agree that we will have no liability or responsibility whatsoever for (a) any failure of another attendee to conform to the code of conduct, (b) personal injury or property damage, of any nature whatsoever, whether arising in contract or in tort, resulting from your access in the Event, (c) any lost, stolen or damaged tickets or goods. Your sole and exclusive remedy for dissatisfaction with the Event or site is to stop using the site or by not purchasing tickets. The limitations in this section will apply even if any limited remedy fails of its essential purpose. The allocation of risk between us is an an essential element of the basis of the bargain between us. Our aggregate liability arising out of the terms or the use of this site or purchase of tickets will not exceed one hundred dollars ($100). In no event will attorneys’ fees be awarded or recoverable. Our liability will be limited under this paragraph to the fullest extent permitted by applicable law, and the provisions of this paragraph will not apply to the extent applicable law permits the the recovery of damages, attorneys’ fees or costs otherwise prohibited under this paragraph. Further, the Covered Parties accept no responsibilities for any damage and/or delay due to cancellations, shortages, sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or causes beyond the Covered Parties’ control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any purchaser’s failure to comply with these Terms and Conditions nor for any purchaser’s failure to comply with applicable federal, state and local law including, without limitation, laws governing the sale, warranty, and return of perishables. You release and discharge and covenant not to sue the Covered Parties from any and all liability, claims, demands or causes of action that you may hereafter have for any injuries, damages or death arising out of your participation in the Event and the Activities and use of the Property, including any injury resulting from the ordinary negligence of the Covered Parties.
You understand that the Covered Parties and all other related parties, including, but not limited to, each of the Company parties and the related parties’ management, employees, and agents, will not be held responsible, financially or otherwise, for any items that are left, lost, stolen, destroyed, confiscated, damaged or misplaced anywhere at the Event site regardless of fault or reason, so act accordingly. The Company recommends that You do not bring any valuables to the Event.
You agree that (a) any and all disputes, claims and causes of action arising out of or connected with the Event shall be resolved individually, without resort to any form of lawsuit or class action, and exclusively through arbitration located in the State of California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with the Event, but in no event attorneys’ fees; (c) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages; (d) you will seek no claims or damages whatsoever for lost or incorrect reservations, emotional distress, mental suffering or anguish or psychological injury of any kind under any circumstances.
You will not speak ill of, write or post defamatory content about the Event, Company or related companies, agents, employees, owners, affiliates or sponsors. You agree that any and all defamatory content must be removed if found to be in violation of our terms, or if we feel that the content is harmful in any way to our brand, reputation or may inhibit future sales. You agree not to message other fans with negative opinions or facts, influence the buying decision of any attendee, or create private groups (social media or otherwise) that spread hate, lies or other derogatory content of the Event or other Covered Parties. Any comments, essays, blogs, posts, articles, messages or otherwise that we deem to be in violation of this will make you applicable to canceling your entire reservation, revoking any tickets without refund, placing you on a “do not book list”, and using the fullest extent of the law to sue or inform you of defamation or other applicable laws.
 

20.2 Indemnification

You further agree to hold harmless, defend and indemnify the Covered Parties from any judgment, costs, damages, including investigation costs, attorneys' fees, expert fees, and related trial, litigation, arbitration, and/ or mediation costs and expenses, relating to any and all claims made against the Event, Girlcation, or any of the Covered Parties relating to any conduct by you at the Event and on the Property, including any injury or loss due to the ordinary negligence of Covered Parties.
If anyone brings a claim against us related to your use of the Site, the Content, your User Content, or your violation of the Terms, you agree to indemnify, defend, and hold us and our affiliated companies, Event Organizers, suppliers, advertisers, and sponsors, and each of our officers, directors, employees, and agents, harmless from and against any and all claims, damages, losses, and expenses of any kind (including reasonable legal fees and costs). We reserve the right to take exclusive control and defense of any claim, and you will cooperate fully with us in asserting any available defenses.
 

20.3 Waiver

By entering the Event, you assume any and all risk and/or danger, known or unknown, foreseeable and unforeseeable, resulting from, or incidental to, the Event, whether occurring prior to, during, or subsequent to, the Event, including, but not limited to, any death, personal injury or loss, damage or liability whatsoever. You understand that your use of your ticket is contingent upon your voluntary assumption of the risk and danger that may result from, or be incidental to, your presence at the Event, whether occurring prior to, during or after the Event, including any actions or omissions of the Covered Parties. Due to weather or other conditions, the floors and/or Event grounds may in whole, or in part, slippery.
By entering the Event, you acknowledge and agree that you may be subject to extremely loud music and sounds, as well as special effects, including, but not limited to, laser lights, strobe lights, flashing lights, a variety of light emitting diodes (“LED”), rapidly changing or alternating images, and use of smoke, fog, and pyrotechnics (collectively, the “Special Effects”) at the Event. These special effects may be considered dangerous for persons suffering from epilepsy or photosensitivity. You assume all risks of any property damage or personal injuries including, but not limited to, hearing loss, seizures, and other health conditions incidental, relating to, or arising from extremely loud music and sounds, and the Special Effects, whether occurring prior to, during, or after, the Event. If you are experiencing a negative reaction to the Special Effects, please locate medical personnel immediately.
You acknowledge and understand that the Ticket is a revocable license to attend the Event for which it was issued, and is subject to revocation and denial of admission without compensation for any reason, including, but not limited to, your attempted or actual violation of any of the rules set forth herein, policy or regulations and for any other action taken by you in violation of any local, state or federal law, or that may endanger other Ticket Holders.
 

20.4 Arbitration, Mediation and Dispute Resolution

You agree that any dispute, claim, or controversy that you claim relating in any way to (a) the terms and conditions, (b) your use of the site, (c) products or tickets sold, distributed, issued or redeemed, or (d) the event, irrespective of when that dispute, claim or controversy arose, unless otherwise solvable by informal dispute resolution (see below) between You and Us, will be resolved solely by binding, individual arbitration in Los Angles, California, as set forth in these terms, rather than in court. You hereby waive any right to a jury trial, and agree that you may bring claims against us only in an individual capacity, and not as a plaintiff or class member in any purported class or respective proceeding. Unless applicable law provides otherwise, the arbitration proceeding and all records pertaining to it—including but not limited to any documents prepared or produced in connection with the arbitration proceeding, as well as the hearing and the arbitration award—will be confidential and will not be disclosed to any third party, except as necessary to obtain court confirmation of the arbitration award.
You understand that We (the Event and Covered Parties) are able to bring lawsuits against You if we see fit, or choose to resolve the manner with arbitration or other ways.
In no event shall the Company Parties be liable for any claim unless written notice is given within six (6) months from the date of the loss. No suit for any cause may be maintained against the Company Parties unless it is commenced within one (1) year after the Event. The parties hereto specifically consent to personal jurisdiction in the State of California.
YOU HEREBY ACKNOWLEDGE AND AGREE THAT ANY DISPUTE IS LIKELY TO INVOLVE COMPLICATED AND DIFFICULT ISSUES, AND THEREFORE, YOU KNOWINGLY, VOLUNTARILY, INTENTIONALLY, IRREVOCABLY AND UNCONDITIONALLY WAIVE ANY RIGHT YOU MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY DISPUTE OR CONFLICT IN CONNECTION WITH THIS AGREEMENT. If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible so as to effect the intent of the parties hereto, and the other provisions contained herein will remain in full force and effect. Company’s failure to insist upon or enforce any provision of this Agreement shall not be construed as a waiver of any provision or right.
Informal Dispute Resolution. You and we each recognize and agree that good faith, informal efforts to resolve disputes often result in prompt, low-cost, and mutually beneficial outcomes. Customer satisfaction is our number one goal. To that end, Site and Event are committed to resolving disputes with its customers in a fair and efficient manner. Therefore, you and we each agree that, before either of us may commence an arbitration or assert a claim in small claims court, you and we will engage in the following informal dispute resolution process:
Prior to commencing any arbitration related to this Agreement, you agree that if you have a dispute with Site or Event, you must first contact our Customer Service Department at: info@girlcation.com
Our team will respond within thirty (30) days with a response. We will use best efforts to resolve the issue with you and come to a reasonable conclusion. All offers, promises, conduct, and statements made in the course of the informal dispute resolution process by any party, its agents, employees, and attorneys are confidential and not admissible for any purpose in any subsequent proceeding, provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the informal dispute resolution process. Any and all information shared during the informal dispute process will remain confidential and will not be disclosed to any third party.
If our Customer Service Department is unable to achieve a satisfactory resolution, then you must notify us in writing about your claim by sending the accompanying form by certified mail to: Girlcation LLC, 11150 West Olympic Blvd, Suite 1050 PMB 1020, Los Angeles, CA, 90064, USA, Attn: Legal Department. It is important that you provide as much information as possible. Our representative will respond within thirty (30) days of receiving this notice.
If the dispute cannot be settled through informal dispute resolution and/or other negotiations, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration, in Los Angeles, California. If a party fails to respond to a written request for mediation within 30 days after service or fails to participate in any scheduled mediation conference, that party shall be deemed to have waived its right to mediate the issues in dispute. If the mediation does not result in settlement of the dispute within 30 days after the initial mediation conference or if a party has waived its right to mediate any issues in dispute, then any unresolved controversy or claim arising out of or relating to the Event or these Terms and Conditions or breach thereof shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, before one arbitrator, in Los Angeles, California. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The venue for any mediation or arbitration shall be Los Angeles, California, and only the substantive laws of the State of California shall apply.
If the matter is still not resolved to your satisfaction, then you agree to begin arbitration by submitting a Demand for Arbitration to the American Arbitration Association. You further agree that exclusive jurisdiction for any such arbitration shall be Los Angeles, California.
The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising out of or relating to the interpretation, applicability, enforceability or formation of this Agreement, including, but not limited to, any claim that all or any part of this Agreement to arbitrate or the Terms is void or voidable. The arbitrator will decide the substance of all claims in accordance with the laws of the state of California. The arbitrator's award will be final and binding, and judgment on the award rendered by the arbitrator may be entered in a court having jurisdiction thereof.
 

20.5 Violation of the Terms

We may investigate any violation of the Terms, including unauthorized use of the Site. We may provide law enforcement with information you provide to us related to your transactions to assist in any investigation or prosecution of you. We may take legal action that we feel is appropriate. You agree that monetary damages may not provide us a sufficient remedy, and that we may pursue injunctive or other relief for your violation of the Terms. If we determine that you have violated the Terms or the law, or for any other reason or for no reason, we may cancel your account, delete all your User Content, and prevent you from accessing the Site at any time without notice to you. If that happens, you may no longer use the Site or any Content. You will still be bound by your obligations under the Terms. You agree that we will not be liable to you or any third party for termination of your access to the Site or to your account or any related information, and we will not be required to make the Site or your account or any related information available to you. We may also cancel any ticket or merchandise order, and tickets or merchandise acquired through your order. We may refuse to honor pending and future purchases made from all accounts we believe may be associated with you, or cancel a ticket or ticket order associated with any person we believe to be acting with you, or cancel your ticket postings, or exercise any other remedy available to us. You agree that your abusive use of the Site may cause damage and harm to us, including impaired goodwill, lost sales, and increased expenses.

 

21.1 Forums and User Content

We may host polls, fan reviews, message boards, blog feeds, social media feeds, and other forums found on the Site (collectively, Forums), and you may be able to submit suggestions, reviews, concepts, audio and video recordings, photographs, artwork, or other materials to the Forums or other areas of the Site (User Content). By submitting User Content, you certify that you are at least 18 years old. You must own all rights to your User Content. If you submit User Content to the Site, you grant us a worldwide, non-exclusive, transferable, sub-licensable, royalty-free right and license to use, reproduce, modify, create derivative works of, distribute, publicly perform, display, archive, and commercialize your User Content, in our sole discretion, in all formats and in all media channels now known or hereinafter discovered, without any compensation or acknowledgment to you or anyone else. This license will not affect your ownership in your User Content, including the right to grant additional licenses to your User Content, except if it conflicts with the Terms. We are not obligated to post, display or otherwise use any User Content, or to attribute your User Content to you. You will not make or authorize any claim against us that our use of your User Content infringes any of your rights. Statements, opinions, and reviews posted by participants in a Forum may be inaccurate, offensive, obscene, threatening, or harassing. We do not endorse and are not responsible for these postings. We will not be liable for any loss or harm caused by the posting or your reliance on information obtained through the postings. You will be responsible for your User Content and the consequences of posting it. By submitting User Content, you represent to us that (a) you own, or have the necessary permission to submit the User Content and to grant the licenses to us under this section, and (b) you have the written permission of every identifiable person in the User Content to use that person’s name and likeness in the manner contemplated by the Site and the Terms or, if the person is a minor, the written permission of the minor’s parent or legal guardian. We will have the right (but not the obligation) to monitor the Site, the Forums, and the User Content, and to disclose any User Content and the circumstances surrounding its submission in order to operate the Site properly, or to protect ourselves, our sponsors, and our users, or to comply with legal obligations or governmental requests.
If we are notified that your User Content does not comply with the Terms, we may investigate the allegation and may decide to remove your User Content and cancel your account. We may also hold you liable for any User Content that infringes the rights of a third party and require you to pay or reimburse us for any amounts we believe are necessary to resolve any complaint.
 

21.2 Protection of Data / Privacy Policy

We do from time to time ask people for their personal details in forms to subscribe for specific information or enter applications electronically. This data is only held for the specified purpose made clear at the time of collection. Data will only ever be shared with a third party for explicit, necessary processing purposes; such as Evey, our primary ticket agency, Shopify, transportation, the venue/event site, or other parties for event management and production.
We may collect “cookies”, browser information or other data for use in retargeting or personalizing our ads to you. This data will not be sold or transferred outside of our company, associated companies, and covered parties, or companies we hire/engage to run advertisements for us. Your privacy is very important to us, and any data shared will not be linked to you. By using our site, you agree to this collection of data. If you do not agree to this collection of data, please discontinue use of our Site.
We comply with all relevant data protection laws in all our dealings with personal data, and we will ensure that our Data Processors do the same.
 

22. Notice That Current Version of Terms and Conditions Apply

We reserve the right, in our sole discretion, to change these Terms at any time. If we change any term or condition, said modification, revision and additional information shall be posted here and shall automatically replace the terms and conditions and become binding on all users of this site. Your continued use of the site following our posting of revised terms and conditions constitute your acceptance of the revised agreement.
You understand that these Terms and Conditions may be changed by the Site, Girlcation or the Event prior to the Event, and if so, the revised Terms and Conditions will apply to you. The most current version can be found at https://girlcationjamaica.com/pages/terms-and-conditions. Your use of a ticket or other entry credential for entry to the Event signifies your binding agreement to the Terms and Conditions in effect at the time of your entry to the Event.
Any changes we make will be effective immediately when we post a revised version of the Terms on the Site. The "Last Updated” date above will tell you when the Terms were last revised. By continuing to use this Site after that date, you agree to the changes. Any purchases of unredeemed tickets will be applicable to the newest version of the terms and conditions. Any redeemed products or tickets (scanned tickets at the event) will use the version of this agreement that was updated most recently before their respective redeemed date(s).
To the extent that these Terms differ from a prior version of the Terms which you previously agreed to, this version of the Terms supersedes and governs.
 

23.1 Additional Provisions

No agency, partnership, joint venture or other relationship is intended or created by your use of the Site.
The heading at the beginning of each paragraph is for reference purposes and no way defines the scope or extent of such paragraph.
 

23.2 Entire Agreement / Severability

This Agreement, including the rules, liability waiver and indemnification provisions, contains the entire understanding of the parties with respect to the matters contained herein and supersedes and replaces in its entirety any and all prior communications and contemporaneous agreements and understandings between the parties, whether oral, written, electronic or implied, (including any and all statements made on the Girlcation or event website). You understand that this agreement between you and the Covered Parties cannot be modified or changed in any way except in a writing signed by an authorized representative of the Event.
It is our belief that the Terms do not contain any provision contrary to law. However, if any part of the Terms is determined to be illegal, invalid, or unenforceable, you agree that: (a) that part shall nevertheless be enforced to the extent permissible in order to effect the intent of the Terms, to the furthest extent of the law, and (b) the remaining parts shall be deemed valid and enforceable. You expressly agree that the foregoing rules, liability waiver, and indemnification provisions are intended to be as broad and inclusive as is permitted by the laws of the State of California and that if a portion thereof is held invalid or unenforceable under any circumstance, it is agreed that the balance shall continue in full legal force and effect, and its application in any other circumstances and the remaining provisions shall not be affected.
 

23.3 Governing law

These Terms, the use of the Site, and any sale of tickets hereunder will be governed by the state of California.
